Identity of the data controller

This notice is based on the Website Visitor Data Privacy Notice published by vMind Bilgi Teknolojileri A.Ş. ("VMIND"), the data controller operating portvmind.com. "VMIND" in this text covers VMIND together with all of its affiliates.

VMIND is bound by every legal regulation it is subject to, its corporate codes, business ethics and ethical rules. Data relating to an identified or identifiable natural person is protected as personal data under Law No. 6698 on the Protection of Personal Data ("KVKK"), its secondary legislation and the decisions of the Personal Data Protection Board (together, "Turkish Data Protection Legislation").

The controller's address and contact details appear in the header of this page; the Data Protection Officer can be reached at [email protected]. The Turkish text is the binding version; this translation is for information.

Categories of personal data processed

During website visits and applications the following general-category personal data is processed: (i) identity data (name, surname); (ii) contact data (mobile phone number, e-mail address); (iii) website visit data (IP address, cookie records, consent records, browsing records, log data); (iv) any other personal data you choose to include in a message you send us.

On portvmind.com, analytics browsing records are created only after the visitor chooses "Accept All" or turns tracking cookies on in the preference center; no analytics record is kept before that choice.

Purposes of processing

Personal data is processed for the following purposes: conducting customer satisfaction activities; running contract processes; carrying out internal audit, investigation and intelligence activities; running and auditing business activities; carrying out marketing activities; fulfilling statutory notification obligations.

Legal grounds for processing

Personal data is processed because it is directly related to the establishment or performance of the contract between you and VMIND arising from your use of the website (KVKK art. 5/2-c) and on the basis of VMIND's legitimate interests (KVKK art. 5/2-f). Managing the performance of a contract VMIND is party to and evaluating requests and complaints are VMIND's legitimate interests.

Where processing requires explicit consent (for example analytics cookies), consent is obtained separately and explicitly through the relevant interface.

Method of collection

The personal data listed above is collected directly from individuals who reach us by visiting the website: information you send through contact forms, e-mail or the console sign-up flow, together with web server log records.

Data collected through cookies and similar technologies is governed by the Cookie Policy.

Recipients of transfers and transfer purposes

In connection with managing the contractual relationship, personal data may be transferred to VMIND's business partners, suppliers and manufacturers, its direct or indirect domestic and foreign affiliates, and service providers that process data on VMIND's behalf under a service and confidentiality agreement. Collected personal data is not shared with third parties other than these processors.

Personal data is processed and stored securely in the finance, contract and supplier-management data processing systems VMIND uses to run its activities. To meet legal obligations, data may be shared with authorised public institutions in accordance with the procedures set by legislation.

International transfers

As a rule, personal data is processed on VMIND's data recording systems located in Türkiye. Where Turkish Data Protection Legislation so requires, transfers abroad take place only with the explicit consent of the data subject or when the other conditions set by legislation are met.

Customer data you host on PortvMind Cloud is outside the scope of this notice; that data is governed by the personal-data clause of the service agreement.

Retention periods

Personal data is processed and retained for as long as the contract between VMIND and the company you represent or work for remains in force. After the contract ends, data is kept for a further 10 (ten) years in line with the limitation periods set in the Turkish Code of Obligations No. 6098 and VMIND's legitimate interests.

During that 10-year period personal data is held under an authorisation restriction so that only designated persons can access it.

Data security measures

Keeping personal data secure is VMIND's priority. Data is stored securely by VMIND or by carefully selected service providers acting as processors under a service and confidentiality agreement.

Strict security measures are applied against loss and misuse as well as unauthorised access or disclosure; the technical and administrative measures taken are designed to meet those required by Turkish Data Protection Legislation.

Rights of the data subject

Under Turkish Data Protection Legislation, individuals may apply to VMIND at any time to: (a) learn whether their personal data is processed; (b) request information if it is; (c) learn the purpose of processing and whether data is used accordingly; (ç) know the third parties, in Türkiye or abroad, to whom data is transferred; (d) request correction of incomplete or inaccurate data; (e) request deletion or destruction; (f) request that the operations under (d) and (e) be notified to the third parties the data was transferred to; (g) object to a result against them produced exclusively by automated analysis; (ğ) claim compensation for damage caused by unlawful processing.

Applications are concluded within the procedures and time limits set by KVKK and the Communiqué on the Procedures and Principles of Application to the Data Controller.
